How do you find the best estate and trust litigation attorney for you? California is full of lawyers who work on probate disputes, but there's no point in choosing one at random. If your beneficiary rights are on the line, you need excellence.
25 years ago I was facing a serious surgery with potential life-changing effects. My friend who was a cardiovascular surgeon counseled that it makes sense to meet beforehand with the doctor who will perform the operation. Take a notebook, and have a spouse or friend take notes. Have questions written out so that you can seek answers to all the matters that concern you. Also, he advised that you should ask the surgeon how many of these specific procedures he has performed in the past year. In addition, ask what the outcomes were. I took my friend's advice.
My wife accompanied me to appointments with possible surgeons. The first looked chagrined when we told him that we would be getting a second opinion. Then we asked him the question: "How many surgeries like this have you performed over the last year?" He answered one or two. What were the outcomes? "Partial paralysis." It didn't sound good.
We went to a second surgeon. We asked him the same questions. "Over the last year I've probably done about a 100 of the same procedures, I guess - I did two yesterday." Now that sounded better. What were the outcomes? "Good - people recovered well." Now the other surgeon told me that I may have partial paralysis? "No way - the area that we're operating on would not involve the danger of partial paralysis." Needless to say, the more experienced doctor became our choice. Things turned out well - and I'm thankful for my friend's advice.
When it comes to finding a probate litigation lawyer, it is wise to start out by seeking out the top practitioners, and then getting at least two opinions. There are several peer review rating systems that may be helpful, including Martindale-Hubbell® Peer Review RatingsTM, Avvo Rating and Super Lawyers. You will want to look at such ratings, but do not make an ultimate decision based entirely upon the ratings. The lessons on excellence that the cardiovascular surgeon taught me still apply.
