The Wolf at the Door Ep. 14: Stories of Elder Financial AbuseHello, I'm Mike Hackard. I'm the chair of Hackard Law, a law firm focusing on estate, trust and elder financial abuse litigation in California's major urban areas. I'm the author of The Wolf at The Door: Undue Influence and Elder Financial Abuse. The book will come out in early autumn. This is episode 14, where I address common stories of exploitation our seniors.

When family members come to me with their accounts of elder financial abuse, they don't present their concerns in legalese. I don't hear terms like breach of fiduciary duty, or citations from California probate law. It's my job as an attorney to figure out the law after I've heard the facts. And I value how my clients tell their stories in their own words, which gives me the ability to apply the law to the truth.

Do people say things like, "My brother stole my mom's house?" You bet. They also relay stories like,

  • "My stepson looted my husband's bank accounts while he was in the hospital";
  • "My stepmom convinced my father to write me out of the will and name her children as the sole beneficiaries";
  • "My sister abused my mother's power of attorney to take all of her money while she was in a care home suffering from Alzheimer's";
  • "My niece managed to persuade my 90-year-old father to transfer his house to her after she's been his caretaker for a few months."

For those of us who represent clients in estate and trust litigation, these stories are far from rare.
