This is episode 20, where I outline the first steps in a battle plan for trust and estate lawsuits.

Extensive experience in estate and trust litigation provides a crucial advantage in representing wronged heirs and beneficiaries. While a general battle plan is necessary, oftentimes success can hinge on flexible action through taking moment-to-moment decisions.

Every dispute between a beneficiary and a trustee, or between a wronged heir and a perpetrator of elder financial abuse, has its own character that will dictate what legal tactics will help pave the way to victory. Winning a trust litigation matter or a will contest will look different according to the circumstances of each case.

One thing I do notice in many cases is how the wrongdoer comes across - initially they'll assume they've concealed facts of elder financial abuse or undue influence. My observation is simple and straightforward: that smug attitude disappears fast once we enact a flexible and aggressive litigation strategy to impose accountability. While the abuser may have started off as arrogant, if he's smart he'll seek mediation, resolution, and a negotiated settlement rather than have his misconduct exposed to the light of day.

When a potential client comes to Hackard Law with an account of how an elderly loved one was financially exploited or their assets looted after their passing, we first ask a series of questions. The answers to these questions will help us shape our initial strategy, the most important elements of which will be real-time actions to safeguard our clients and hold wrongdoers accountable.
