When it comes to trust lawsuits and especially cases of elder financial abuse, you can't accept the given - that is, the conventional wisdom of the day. I've noticed how some of the best litigators consciously or unconsciously follow a strategy called the OODA Loop, a system of action developed by the late US Air Force Colonel John Boyd. It's a decision cycle that stands for Observation, Orientation, Direction, and Action. The most effective way to get the upper hand on your opponent is to observe and respond to challenges quicker than they do. When you have the advantage of speed, you can get inside their decision cycle and attain victory.

In difficult estate, trust, and probate litigation matters, the OODA Loop is invaluable. While an estate planner would act in a predictable fashion, an estate litigator must be unpredictable to the adversary in strategy and tactics. Litigation is a realm of conflict where clarity is rare, and a good litigator will use this situation to protect the interests of beneficiaries whose rights have been violated.
