This is episode 22, where I emphasize the importance of quick, decisive action in probate and trust lawsuits.

In cases of elder financial abuse or undue influence, delay against a bad trustee or another wrongdoer will only cost you further down the line. Here are five reasons why:

1) There are specific time limits in place to dispute a trust. A challenge that comes too late could result in a failure to file against the trustee.

2) Wrongdoers will move trust assets to hide them from rightful beneficiaries, including selling real estate in sweetheart deals. The sooner you move against a bad trustee, the better.

3) A legal concept called "laches" in plain language means "sitting on your rights." If a beneficiary chooses to delay, their chances for recovery lessen as the clock runs out.

4) Moving quickly to remove a trustee and appoint a successor trustee, either a professional fiduciary of member of the family, can stop wrongdoer misconduct and safeguard remaining trust assets.

5) Rapid action can also ignite the process of legal discovery - where known and unknown assets can be tracked down, identified, and potentially recovered.
