Selection into this prestigious group is a four-part process. According to Super Lawyers Director of Research, Julie Gleason, the four parts include:
- Nomination: Diverse list of the top attorneys nominated by their own peers;
- Independent Research - Validated with third-party categories, conducted by an attorney-led research team
- Evaluations - Candidates are grouped into categories based on practice area and reviewed by those attorneys who received the highest totals from each category
- Final Selection - 5% of Attorneys Selected To Super Lawyers - 2.5% of Attorneys Selected To Rising Stars

While the 40 Estate & Trust Litigation lawyers are located in different counties, it is common for litigators to prosecute and defend probate, trust and estate litigation throughout Northern California. The Judicial Council of California's 2014 Court Statistics Report, Statewide Caseload Trends, 2003-2004 Through 2012-2013 provides interesting information as to the number and classification of the cases filed in the statewide Superior Courts. For FY 2012-13, the "probate filings totaled 41,419 cases." Table 2 "Court Trials, by County and Type of Proceeding to the Report" lists Probate and Mental Health trials by county. The information as to some of Northern California's more populous counties indicates that there is a relatively wide variation on the number of court trials, and that the incidence and number of such trials is not necessarily directly related to a particular county's population base. Extracting the information provided in the report, we can see the following:
