I'm the chair of Hackard Law, a law firm focusing on estate, trust and elder financial abuse litigation in California's major urban areas. I'm the author of The Wolf at The Door: Undue Influence and Elder Financial Abuse. The book will come out in early autumn. This is episode 11, where I draw up a brief protocol for investigating Alzheimer's-related cases in estate and trust lawsuits. Each protocol includes the following elements:

Timelines: Timelines are vital in helping to establish mental capacity, elder vulnerability, and facts of elder financial abuse or undue influence.

Medical Records: The notes of a treating physician play an important, if not always conclusive, role in cases of disputed estates or trusts. Tracking the onset of Alzheimer's or dementia can show an elder's susceptibility to financial exploitation.

Accounts by Family, Friends, and Caretakers: Family and friends are reliable witnesses, though sometimes any of us can have flawed memories. Professional caretakers usually will take notes during their shifts, which means they can potentially offer objective testimony on any suspected elder financial abuse of an Alzheimer's patient.
