I'm the chair of Hackard Law, a law firm focusing on estate, trust and elder financial abuse litigation in California's major urban areas. I'm the author of The Wolf at The Door: Undue Influence and Elder Financial Abuse. The book will come out in early autumn. This is episode 12, where I discuss ways lawyers can mitigate the risks Alzheimer's disease or dementia can pose to an estate or trust.

An estate attorney must analyze which standards of mental capacity fit the client's condition as well as the client's will or trust documents. A good lawyer will be able to explain they reached these conclusions.

An estate attorney can judge capacity through open-ended questions. It's important to take detailed notes that help determine client capacity, and to be on the lookout for any red flags of elder financial abuse or undue influence.

Undiagnosed Alzheimer's or dementia is not only harmful to a senior client's well-being, but it also poses a danger to the estate or trust. Elder financial abuse and exploitation are more common than you might think, and all details of client meetings should be documented along with any irregularities or abnormal behavior. An estate or trust made without such precautions is potentially open to litigation challenges down the road.
