Your Legal Rights | Interview with KALW's Chuck Finney

Your Legal Rights Interviews Michael Hackard | Trust Litigation.jpgNext week on Wednesday, January 3rd, I'll be live in studio at KALW 91.7 FM, San Francisco's NPR affiliate. My host will be Chuck Finney, whose program Your Legal Rights is a leading resource for consumer protection nationwide. Chuck is also a veteran lawyer with 51 years of experience, and he has served 33 years as a San Mateo County Deputy District Attorney with a special focus on consumer and environmental safeguards. Chuck and I will be discussing my new book The Wolf at the Door: Undue Influence and Elder Financial Abuse.

Because of the dire threat elder financial abuse poses to our California communities and our families, I'm glad to have the opportunity to outline how we can take preventive measures against wrongdoing and spot vulnerabilities before it's too late. Financial exploitation of our seniors is already severely underreported, with only one in 44 cases coming to the attention of the authorities. That translates to unchecked looting of family fortunes - from estate property and trust assets to savings accounts and securities.

Undue influence and elder financial abuse are becoming increasingly common, and your awareness can go a long way in stopping it. Whether it's a bad trustee, someone abusing a guardianship, or misuse of power of attorney, the sooner we take legal action against an abuser, the better the chance of recovery. Security measures like revocable trusts, financial oversight, and communicating with loved ones can also help shield elderly family members from predators. Baby Boomers are turning 65 at 10,000 people a day, so the problem isn't going away. We'll cover these challenges and ways to fight back on Your Legal Rights next Wednesday at 7 PM Pacific Standard Time, and I hope you'll tune in live to listen at KALW. The full hour program will be uplinked to NPR satellite via funding by the National Board of Trial Advocacy. Have a Happy New Year.
