Michael Hackard on MarketWatch | Elder Financial Abuse

Michael Hackard on MarketWatch | Elder Financial AbuseIt's a privilege to have a chapter from my book, The Wolf at the Door: Undue Influence and Elder Financial Abuse, featured in The Wall Street Journal's financial newswire MarketWatch. The chapter concerns a phenomenon I've encountered frequently in estate and trust lawsuits: conflicts between stepmothers and the natural children of a decedent over property and assets. The chances of a dispute rise dramatically when a stepmother's vision for the future of a family trust is at odds with what her husband originally intended for his children from his previous marriage.

There are many components to why stepmothers can play such a visible role in cases of undue influence or elder financial abuse. I want to stress that I'm not saying stepmothers have bad intentions - rather, I'm just pointing out a reality that emerges from factors like average age of mortality between men and women, the demographic preponderance of widows compared to widowers, and the often-strained relations present within blended families.

At Hackard Law we are dedicated to representing beneficiaries throughout California in estate and trust litigation, and we're also proud to spread the word on the growing challenge of elder financial abuse. If you have recently experienced negative impact from trustee wrongdoing or elder financial exploitation, you can contact us at Hackard Law: 916-313-3030. We want to hear your story.
