Deathbed Transfers | Estate & Trust Litigation.jpgThe San Francisco-based project Seven Ponds, devoted to creating dialogue on death and the process of dying, reviewed my book The Wolf at the Door: Undue Influence and Elder Financial Abuse. I'm glad they found it informative and useful. Seven Ponds is especially sensitive to the topic of elder financial exploitation since seniors who are near death will often be vulnerable to predators.

The opportunistic, the greedy, and the unethical will take advantage of dying elders in order to change estates and trusts in their favor, violating the rights of the elderly victim as well as their intended beneficiaries. Deathbed transfers, while at times a legitimate way to pass on an inheritance, are sometimes exploited by wrongdoers. California's most recent comprehensive law against elder financial abuse, the Elder Abuse and Dependent Adult Civil Protection Act, aims to protect our vulnerable loved ones. At the same time, the law will only be as effective as the response from our families and communities.

I'd like to thank Seven Ponds for calling attention to the challenges our society faces over various approaches to caring for the sick and dying. Injury, incapacity, or cognitive impairment don't lessen the human dignity of a hospice patient, and that goes for estate and trust inheritance rights of beneficiaries as well. Keeping your elderly loved ones safe is indeed a full-time job, but we can all ease each other's burden by spreading awareness. Every voice counts.
