Alzheimer's, Widowed Stepmothers & Estate Crimes | Mediation Hello, I'm Mike Hackard. Today, let's talk a bit more about mediation. In my experience, the best mediators are people who have previous experience in probate matters. Mediators of this caliber typically will charge $400-$1,000 per hour and usually require a minimum of a half day's work. That said, there are also a few of California's top estate and trust mediators who still serve as private counsel who possess decades of experience and bring valuable insight to the table. The costs may seem like a lot, but a good mediator knows how to cut through the issues quickly and efficiently, and that saves both sides massive sums compared to a protracted litigation slugfest in court.

A good mediator who has experience in Alzheimer's and lost inheritance cases will survey an estate conflict and understand how the two sides can best reach a compromise. At times this is done by examining the strengths and weaknesses of each side in an unbiased, impartial manner. Each side should have the opportunity to explain their point of view to the other. In addition, the entire process is deliberate and considerate to each party, since either of them can walk out at any time.

The great benefit of mediation is that it will typically wrap up a case in the space of one day. Months of preparation and mountains of paperwork build up towards litigation. If both sides agree to mediation to save time and money, then a mediator has the power, with the consent of the parties, to resolve a disinheritance conflict on the spot. It's by no means a perfect system - I've come across mediators who were unfamiliar with elder financial abuse law. By and large, though, most mediators know what they're doing and are worth the investment!
