Alzheimer's, Widowed Stepmothers & Estate Crimes | Episode 8

Alzheimer's, Widowed Stepmothers & Estate Crimes | Episode 8Hello, I'm Mike Hackard. I lead Hackard Law, a law firm that focuses on significant estate, trust and elder financial abuse litigation in California. I'm the author of the new book Alzheimer's, Widowed Stepmothers & Estate Crimes, now available on Amazon.

Today let's take a look at the problem of cognitive decline and how it affects the lives of seniors. Conditions like Alzheimer's and dementia will inevitably produce new challenges, complications and even dangers for an elder and their family. This also applies to their financial accounts, estates and trust assets. It's sad but true that there are always predators without any conscience who will jump to take advantage of the elderly, the confused and the lonely. Sociopaths don't share any of our concern for another person's well-being. Unfortunately, some of these wrongdoers are even family members - it's an all-too-common reality we've seen in many of the cases we litigate.

Fraud and abuse take on many different forms, and abusers gravitate toward vulnerable individuals like seniors with Alzheimer's. Most of us have heard of the numerous e-mail, snail-mail and telephone scams that prey on the elderly. Then there's the cases of opportunistic financial predators, like a supposedly "friendly" neighbor who offers to mow the lawn for a friendly sum of $500 a week. Or maybe they offer to by an elder's house for two thousand dollars, "a real bargain." Worst of all, the wrongdoer can be a member of the family, often a substance-addicted child or grandchild. They'll use isolation, threats or manipulation to control their ailing parent or grandparent, and they'll hijack estate or trust assets to the harm of the elder and rightful beneficiaries. Undue influence is more common than you might think.
