Personal Injury Cases for Minors | What I Wish I Knew
Hi, I’m Stephanie. I’m working at Hackard Law while going to college. I’ve learned a lot here over the last couple years, and there’s something important I want to share.
How often have you heard ‘I wish I knew then what I know now’? Let’s go back in time to a few years ago. I was a sophomore in high school. Class was over, and I was waiting outside for my ride home.
I heard the sound of a car crash. A motorcyclist flew off his bike and the motorcycle swerved toward me. It slammed into me and my books went flying. I was tossed clear onto a driveway.
I didn’t know what happened. Everything hurt. I was in shock. It’s hard to describe the feeling, it was almost unreal.
I picked myself up off the driveway as my ride pulled up. I didn’t know that I should’ve stayed to be part of the police report and get treated by first responders.
The next day, I couldn’t walk and had to go to the hospital. I was bruised and they said I had a traumatic brain injury. I got ibuprofen and crutches and was out of school for a week. All because a motorcyclist was recklessly speeding.
Bottom line – someone else’s negligence caused my injury. And I didn’t know what to do about it. But I do now.
I’ve learned from working at Hackard Law that since I was a minor at the time of the injury, the two-year statute of limitations began to run when I turned 18, not when the injury occurred.
So, my advice for minors involved in personal injury cases: don’t flee the scene. Go to the hospital. Get the police report. Have your parents hire an experienced lawyer. This is not small claims court, this requires experience. Experience that I see in Hackard Law.
