Despite a family’s best efforts, trust distribution disasters can still occur. When they do, it’s crucial to act quickly and strategically:
Seek legal counsel: Engage an experienced trust and estate attorney to understand your rights and options.
Consider mediation: Before resorting to litigation, explore mediation or other forms of alternative dispute resolution.
Document everything: Keep detailed records of all communications and financial transactions related to the trust.
Protect the assets: If you’re a trustee, take steps to secure and protect the trust assets during the dispute.
Maintain perspective: Remember that family relationships are often more valuable than material assets. Strive to resolve disputes in a way that preserves these relationships where possible.
